The New Year brings new changes to many laws including California’s Family Code. Some of these changes or amendments to California’s Family Code include:
AB 1407 (which creates a new Section 6347 of the Code), which becomes effective on July 1, 2016 boosts protections for victims of domestic violence. This new addition to the California Family Code will allow victims of domestic violence to ask the Family Court to order cell phone and wireless telephone providers to transfer accounts held and/or controlled by those accused of domestic violence. The aim of this new addition is to protect lines of communication for victims of domestic violence and allows for the transfer of billing and account information to the party seeking the protection order in Family Court. It also allows the Court to keep confidential the telephone number of the party requesting the court order.
AB 1014 (effective January 1, 2016) allows for firearms and handguns to be taken by the state if a judge determines an individual is “at risk for violence”. Under AB 1014, family members and law enforcement officials will be able to seek a specialized restraining order which can remain in place for up to one (1) year.
Changes to California’s Family Code concerning factors to be considered in ordering spousal support were effective January 1, 2016 and current bills working through the California legislature seek to change or better define the “date of separation” during a divorce proceeding.
